The District Court of Mannheim, Germany ruled in favor of Nokia in a patent lawsuit against vivo. The lawsuit involves a standard-essential (SEP) Nokia 4G patent and could see vivo pushed out of the German market. Nokia had previously won lawsuits against Oppo and OnePlus over the same SEPs, which resulted in a ban on the sale of Oppo and OnePlus devices in Germany.
vivo has released an official statement confirming that it will suspend sales and marketing of the affected products via the official channels of vivo Germany. The company is also set to appeal the court’s decision and is continuing to negotiate a new IP deal with Nokia.
The official statement also includes comments on Nokia’s failure to offer fair, reasonable and non-discriminatory (FRAND) terms for negotiating a deal. Users can still purchase vivo products through official channels and third-party resellers in Germany. vivo has ensured that its long-term commitment to the German market remains unchanged and that its customers will also be able to rely on its services in the future.
